1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Tribute Memorial platform, including all websites, mobile applications, and related services operated by Tribute Memorial ("we", "us", or "our"). By accessing or using our services, registering for an account, or clicking "I agree" on any consent screen, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use Tribute Memorial. We may update these Terms from time to time; continued use of the service after any changes constitutes your acceptance. You will be prompted to re-consent whenever a material update is made.

2. Eligibility

You must be at least 18 years of age to create a Tribute Memorial account and use our paid features. By creating an account, you represent and warrant that you meet this age requirement and that the information you provide during registration is accurate, complete, and current.

Tribute Memorial reserves the right to verify user identity and eligibility at any time. Accounts found to have provided false information may be suspended or permanently terminated without prior notice.

3. Account Registration

To access most features, you must register for an account. You agree to provide truthful and accurate registration information and to keep this information up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

You must notify us immediately at support@tributememorials.com if you believe your account has been compromised. We are not liable for losses resulting from unauthorised use of your account.

On certain account types or in specific jurisdictions, we may require account approval by our team before granting full access. This is a verification step, not a guarantee of ongoing access; we reserve the right to suspend accounts that subsequently violate these Terms.

4. Use of the Service

Tribute Memorial provides a platform for creating and maintaining online memorial pages for deceased individuals and pets ("Tributes"). The service enables users to share memories, photos, videos, life timelines, and condolences. It also facilitates donations to families and charitable causes in memory of the deceased.

The service is provided on an "as is" and "as available" basis. While we strive to maintain continuous uptime, we do not guarantee uninterrupted access and are not liable for any disruption of service.

5. Memorial Content

You retain ownership of all content you upload to Tribute Memorial, including photos, videos, biographical information, and written memories ("User Content"). By uploading content, you grant Tribute Memorial a non-exclusive, royalty-free, worldwide licence to store, display, and process that content solely for the purpose of operating the service.

You represent and warrant that you have the right to upload and share all content you submit, that it does not infringe any third-party intellectual property rights, and that it complies with all applicable laws. Tribute Memorial reserves the right to remove content that violates these Terms without prior notice.

Memorial pages created for living individuals without their consent are strictly prohibited. Tribute Memorial is a service for commemorating the deceased and may not be used for any other purpose without written consent from our team.

6. Donations & Payments

Tribute Memorial enables visitors to make voluntary donations to memorial owners ("Donations"). These donations are processed through third-party payment providers including Stripe, RazorPay, PayPal, and Binance Pay. By making a donation, you agree to the applicable payment provider's terms and conditions.

Donations are subject to a 10% platform fee deducted at the point of receipt. The remaining 90% is credited to the memorial owner's Donation Balance and may be withdrawn to their nominated payment method. Tribute Memorial is not responsible for the use of donated funds once they have been disbursed.

All donations are final and non-refundable unless required by applicable law. If a donation was made in error, please contact us at support@tributememorials.com within 24 hours and we will review the matter at our discretion.

7. Subscription Plans

Tribute Memorial offers a free tier and paid subscription plans (Monthly, Annual, and Eternal). Paid subscriptions are billed through your chosen payment provider. Monthly and Annual plans renew automatically unless cancelled before the renewal date. The Eternal plan is a one-time payment conferring permanent Premium access.

Subscription prices are displayed in USD and INR depending on your detected region. Prices are inclusive of all applicable taxes unless stated otherwise. We reserve the right to change prices with 30 days' notice to active subscribers.

Cancellation takes effect at the end of the current billing period; you will retain Premium access until then. No partial refunds are issued. If a subscription renews unexpectedly, contact us within 7 days for a review.

8. Intellectual Property

All platform elements — including the Tribute Memorial name, logo, interface design, code, and proprietary features — are the intellectual property of Tribute Memorial and are protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on these elements without our express written permission.

9. Prohibited Conduct

You agree not to:

• ✕ Create memorial pages for living individuals without their express consent
• ✕ Upload content that is defamatory, obscene, hateful, or unlawful
• ✕ Impersonate any person or entity or misrepresent your affiliation with any person
• ✕ Use the platform to solicit funds for purposes other than commemorating the deceased
• ✕ Attempt to access, reverse-engineer, or circumvent any security feature of the platform
• ✕ Use automated scripts, bots, or scrapers to access or extract data from the service
• ✕ Harass, intimidate, or harm other users or memorial visitors
• ✕ Upload content that infringes any third-party intellectual property rights
• ✕ Use the service for any commercial purpose not expressly permitted by these Terms
• ✕ Violate any applicable local, national, or international law or regulation

10. Termination

Tribute Memorial reserves the right to suspend or permanently terminate any account at our discretion, with or without notice, if we believe the account is in violation of these Terms or poses a risk to other users or the platform. Accounts may also be suspended pending review of reported content or behaviour.

On termination, your right to access the service ceases immediately. Memorial pages associated with terminated accounts may be taken offline. We are not obligated to retain or provide you with copies of your content following termination, though we may do so at our discretion.

You may delete your account at any time via Account Settings. Deletion will permanently remove your profile and all associated content and cannot be undone.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Tribute Memorial and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or emotional harm arising from your use of or inability to use the service.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) USD $50. This limitation applies even if we have been advised of the possibility of such damages.

The service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tribute Memorial is legally registered, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

For users located in the European Union: nothing in these Terms limits any rights you may have under EU consumer protection law or GDPR. For users in India: these Terms are subject to the Information Technology Act 2000 and applicable Indian consumer protection legislation.

13. Changes to Terms

We may update these Terms at any time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the version number and effective date at the top of this page. Registered users will be prompted to review and re-accept the updated Terms on their next login.

Your continued use of Tribute Memorial following the effective date of any revised Terms constitutes your acceptance of those changes.
